Sex, Lies, Videotape and Immigration

Ok that title has nothing to do with this post, that was just to get you excited on this dull Thursday morning. You probably checked your email in the hope that your attorney sent you a positive email about your immigration application. Then you checked your Processing dates page to see if anything changed on [...]

I-140 processing dates move forward….but how?

I am at a conference with limited access to the ‘Net so this posting is sort of outdated. Yesterday, USCIS Processing dates at NSC and TSC for I-140 moved significantly..See full details here
NSC:
EB-3 and others - July 24, 2007
EB-2 - March 13, 2008
TSC:
EB-2, EB-3: August 1, 2007
EB-1 - July 25, 2007
But wait a minute, [...]

USCIS response to I-140 backlog, premium processing and other questions

The USCIS National Stakeholder Meeting on September 30 transcript is available now. Here’s the question about I-140’s that we were most interested in.
Question: In TSC and NSC, there is dramatic delay for last July/August concurrently filed I-140. At the same time, TSC quickly approved many non-concurrently filed I-140 with application mailing dates later than last [...]

Prepare for more delay…

More reasons why it is unlikely that I-140 or for that matter, I-485 processing will continue to remian sluggish (it can’t get any worse, it’s rockbottom already for most of us)
1. There was a surge in EAD Renewal applications in August 2008. USCIS plicy requires applicants to apply a maximum of 120 days in advance [...]

My Letter to AILA

Respected AILA Attorneys and Officers:
As you are aware, the USCIS has delayed processing I-140 applications, especially for EB3 filers from NSC? We’ve been waiting 18 months and cannot switch jobs because AC21 requires an approved I-140. Recently, reputed Immigration Attorney reported that they are processing the I-140’s that are not affected by retrogression, which confirms [...]

USCIS Processing Dates Goof-up?

Notice the dates say “as of July 31, 2008″. Now even the USCIS posting dates are retrogressing ;).  I hope someone corrects this mess.

The actual processing dates on the page does not appear to have changed..

Two more EB3 I-140’s from NSC approved today

More reason to believe that NSC is approving I-140’s based on Labor filing date for EB-3’s.
For EB-2 filers, I am not sure what’s going on. Yesterday, there was an approval for a non-concurrent I-140 filing that was applied in May 2008, while there are plenty of from June and July 2007 EB2 filers that are [...]

I-140 Backlog is 18 months now for EB3 NSC

NSC and TSC  September 2008 processing dates updated today shows NO PROGRESS. EB3 NSC is still at March 30, 2007. EB3 TSC is at July 27, 2007.
NSC Processing Dates
TSC Processing Dates
The backlog is now 18 months. That’s over 100,000 people waiting in line for over 18 months without the ability to switch their jobs even [...]

USCIS NSC & TSC differences - How does this make any sense?

NSC (Nebraska Service Center) and TSC (Texas Service Center) are two branches of the USCIS. To the lay immigrant, they pretty much perform the same duties in two different states. Even if there are differences, as long as the two process the SAME form for 2 different sets of applicants, does it not make sense [...]
