I-140 processing dates move forward….but how?
I am at a conference with limited access to the ‘Net so this posting is sort of outdated. Yesterday, USCIS Processing dates at NSC and TSC for I-140 moved significantly..See full details here
NSC:
EB-3 and others - July 24, 2007
EB-2 - March 13, 2008
TSC:
EB-2, EB-3: August 1, 2007
EB-1 - July 25, 2007
But wait a minute, according to the Trackitt tracker and all other immigration portals, there haven’t been very many approvals for EB-3 I-140’s in that time-frame…so how is USCIS making this claim?
Moreover, processing dates mentioned are for August 31, 2008 not September 31, 2008. This means that these dates are already 45 days backlogged.
There are times when you need to be nice and not bother customer service with calls (Actually in all these years, I’ve never called the USCIS because I know my dates are not current). But now they are, for me and for many others as far as I-140 processing is concerned. My only advice to you - CALL CALL CALL. It is possible that the USCIS wants people to call and will process I-140’s for those that call and raise a service request. Again, makes no sense to me…but that’s USCIS for you.
Now before you rush to your phone, here’s a little tip. It’s best if your employer or employer’s attorneys call USCIS. This is because the I-140 is an employer petition and any delay in I-140 processing is between the employer and the USCIS. There is a much better chance that USCIS will actuall accept a service request if you go this route.
Is USCIS playing another trick on us? Will they correct the dates and go back 5 months on it again and repeat the July 2007 show? We’ll know very soon..

Following my saga with the help of congressman, yesterday I received an e-mail from congressman saying “My congressional liaison at the USCIS contacted me today and advised: received file and forwarding to supervisor. More than likely it will take approximately 30 to 45 days to process. As soon as I receive additional information, it will be forwarded to you”
So, my RD is 04/06/07, USCIS at NSC says EB3 porcessing date is 07/24/07 and the answer to my congressman is it will take another 30-45 days just because we are pushing this case. In other words, I have no confidence in such dates on the bulletins from USCIS, but you are right, we have to flood the telephone lines launching Service Requests.

I spoke to my attorney and she mentioned that there is no need to hurry for I140 to get approved as it would be few years for the I1485 PD to get current.
When asked about AC21,she responded that getting I140 approved before PD is not a right but a priviledge for a few lucky ones, and as it is there a half a million of cases for 485 pending since last august 2007.

Well, your attorney is too optimistic and not thinking of employee’s benefit. I140 is a crucial step in GC processing and there are number of horror stories were I140 is denied due to reasons that are very simple. Incorrect preparation of the forms, USCIS not satisfactory about companies ability to pay,issues with documentation the list is long.
No GC filer can sleep in peace until I140 is approved. I really wish USCIS re-instate premium processing for I140.
If you have I140 approved there are many benefits like priority date portability.

Victor could you tell me how you were able to contact your congressman and how did you get him/her involved? I would like to do the same here in MN and would like advice on how to do so. I have receipt of I-140 from May 31 2007 and is still pending even though the USCIS shos procession time of July 2007. This is almost agonizing

AC21 is a privilege, I agree with that. But USCIS has no right to deny us that privilege either. In general, 7-8 year waits for a green card are ridiculous to start with. On top of that, if you are going to say that to get the green card, you will have to be bound to your sponsoring company for that long, that just does not make any sense. I know immigrants don’t enjoy unrestricted rights to work in the US, but there is no reason for torturing them with such waits and making their transition to becoming a permanent resident/citizen that much harder. The country needs us as much as we need them, it’s a mutually beneficial relationship and both need to treat each other with respect. I believe 7-8 year waits for Green Card approval is not treating immigrants respectfully.

the congressman turned my case to his district (local)aide, then, she has been pushing through USCIS to help me out on this matter. It’s much easier to speak with district aides since they reside in the same community as you live (at least on this case)than congressman which works in D.C.
Try to contact the congressman’s aide for your district.

I sent a letter to the congressman a month ago but not reply so far. My notice date is 07/24/2007 and case is still pending. But my case LUD is 07/27/2008, don’t know what they update it with.
One interesting thing to share is I got my EAD with two year extension even though my I-140 is still pending.

Navee, a lot of us are in the same boat - my receipt date is 5/11, Victor’s is in 7/4. I got an automated response from my congress person, that was actually irrelevant to the topic of my email inquiry :). What you need to do it try calling their office. If that doesn’t work, you can try what Victor suggested above…somehow try to contact a local rep that works with Congress…google searches can reveal some pretty powerful info..
Also, I think the current processing dates are a BLATANT LIE. I am following the approval trend on daily basis and see absolutely no approvals from that time frame. The only ones getting approved are those that have priority dates in 2004-2005 timeframe, even though that’s not how it’s supposed to be..

Srini, Thank you. I am worried how long I-140 is going to take to get it approved. My priority date is March 2005. Current employer is planning to do EB2 for me so that I use the priority date from my EB3..I am reading some articles that they are processing based on priority date for that category. If that is the case I will never be able to change my category…

I work for Company A and is a subsidary of Company B. Recently reorg happened they moved us to Company B.
I have EB3/I-140 Approved/ I-485 Pending more than 180 days so they decided to do AC21. And also, Company A filed EB2 LC for me which is pending. Now I am working for Company B and there are no changes to my duties. Do u see any issues when Comapny B files I-140 with “Successor of Interest”.
Your suggestions on this is higly appreicated.
