2 year EAD’s require I-140 approvals now
Two leading law firms have reported that the USCIS now requires that the I-140 be approved before 2-year EAD’s will be issued. Some of us may have been lucky and already received it.

More reason for USCIS to reinstate premium processing for I-140’s. Those that need the EAD will choose to go with premium processing, thereby making USCIS more money.
Lay-offs are happening in almost every corporation. With today’s failed Bailout plan, more layoffs and tougher economic times appear ahead of us. That doesn’t stop USCIS from denying 140,000 immigrants their rightful option to find new employment…

From Fact Sheet:USCIS to issue Two year EAD Effective June 30, 2008 (last update 09/28/08)
“The two year EAD is available to pending adjustment applicants (i.e., those who have filed a form I-485, Application to Register Permanent Residence or Adjust Status)who have filed for an EAD under Section 274.a.12(c)(9)of Title 8, Code of Federal Regulations (8 C.F.R.)and who are currently unable to adjust status because an immigrant visa number is not currently available. USCIS will continue to grant EADs that are valid for one year for adjustment authorization under 8 C.F.R. Section 274a.12(c)(9). In order to be elegible for an EAD with a two year validity period, an applicant’s I-140, Immigrant Petition for Alien Worker, must be approved.”
So, I filed my EAD by July, 2008 and received it in August, 2008 with the Two years validity. My I140 is pending at NSC BUT IF I GO WITH THE EAD RULE POSTED ABOVE, THAT MEANS MY I-140 IS ALREADY APPROVED AND USCIS HAS NOT CHANGED/UPDATED OR SENT THE APPROVAL NOTICE??? I know this question has been launched from hundreds of people, I just want to know a recent comment from the public.

I just think that the USCIS does not follow its own rules at times. This rule was set forth to go in effect from July but seems to have been enforced only recently.
Mine was applied on June 4 and I got the 2-year EAD.
