H1B-EB3 Trap

Happy New year 2010 to ALL!
I have been working since June 2003 as a computer system administrator for a fortune 500 company on a H1B EB3 visa. I hold a Bachelor degree in Computer Engineering from a US institution. I-140 has been filled and approved and Priority date is June 2007. Lord I am stuck! The job sucks and you have to put up with what US citizens would not put up with, family and personal life has been destroyed over this. Man what a tribulation! Basically I am told to wait get old and rot on the job for another 10 years before green card comes my way. Does anyone have a suggestion to get out of this madness? Going back to Africa is not an option at this time.

I’m in the same boat. Graduated with a BS from an American University in 2004, been working for a prominent commercial real estate firm since early 2005, I’m stuck with this company and my priority date is May 2007.
Apparently there’s no way out, we just need to be VERY patient and wait, going back to Europe is not an option for me either…
in the meantime I keep applying every year for that Visa lottery…who knows that I might win it through that…
I just wanted you to know there’s a lot of people in the same situation like you an me.

Guys, I feel your pain. The CIR next year “might” (and chances are small, to be honest) possibly provide some relief and change to the currently wretched system of diversity based immigration. People from China, India and Mexico have much longer waits in fact - most wait for about 10 years to get their green cards these days.
I am on EB3 from India and feel like puking every time i think of the situation I am in and all the years I am wasting unable to do what I want to do.
If you have an approved I-140, you can change jobs on AC21 btw..

I am on EB3 and have apllied for my 10th yr H1B visa extension. A few EB3 applicants have formed group - http://immigrationhope.org/ , so that we can take our case to the lawmakers. We are trying to get as many EB3 applicants as possible in our group so that we can attract more attention. Join us and together we could approach lawmakers.

Come on Murid, your priority date is only Jun-2007 and you expect your case to be processed FASTER ? YOU APPEAR TOOOOOO GREEDY, my friend.
I’m from India, holding a Masters degree, which was apprised to be equivalent to that of US. I’m also on EB3, thanks to my former mom-pop-shop employer, who declined to file in EB2 though I’m fully qualified citing “company policies”; my priority date is Jan-2001 (though, I option the LC substitution and applied for I-140 in 2004 and I-485 in 2005) and I’m still waiting buddy. I’ve been applying for the extension of my H1B (me too the 10th year extension)
When these lawmakers discuss about Immigration reform, they’re talking about ONLY illegal immigrants and legalizing them. They don’t even care (I doubt if they’re even aware of) about the plights of those who live and work here legally, play by the rule, pay taxes and so on.
Once my collegue - who’s an American - joked saying this :
“if you need GC, go out of US and enter illegally and you’ll be taken care”

Everything has a price in life. We want to live in US; but, dont want to wait. We had better jobs in India; but, did not liked the surroundings. This is not a perfect world. We have to find happiness no from situations and commodities; but, happiness as a choice. Millions go and die hungry around the world. You are in much better place my friend. Count your blessings.

If you’ve been working since 2003, then you have over 5 years of experience. Perhaps find another job that requires a master’s, and qualify for EB2 using your BS+5? Or get a master’s degree in your free time, and qualify for EB2 for another job? If you’re from Africa, you shouldn’t be subject to any cutoff dates.
