What bothers you most?

Hey fellas,
Every time I think of the green card, I experience a wide array of emotions ranging from impassioned to blood boiling, But you have to wonder what bothers you the most…
Is it -
1. Given the plethora of issues in this country competing for attention, this is probably the least likely time that legal immigration will take the spotlight
2. Your priority date is pretty recent and unless there is another July 2007 visa gate, there’s almost no chance of you moving to the 3rd stage with benefits such as EAD, anytime soon
3. The L1, J1 visa holder you know and somehow always bump into reminds you that your spouse stays at home while theirs go to work
4. Your employer simply refuses/ refused to file PERM under EB2 stating the min. job requirements clause (even though you have a masters degree)
5. The J1 visa holders (yeah them again) who file PERM (once they get their H1b) under EB1 get their green cards in 1 year (yes this is true)
6. The “well-wisher” who always told you to stay put in your home country>find a job>settle down>never ever worry abt green card>and if you ever wanted to visit the US, have you BPO employer file an L1/B1 visa for you
There’s more but these few always standout. This isn’t a poll…just my thoughts before I hit the sack. Feel free to add to this list and maybe someday we’ll have a poll (Is the Moderator reading this??)

1. Even if this nation is not having other issues, legal immigrants WILL NEVER EVER get attention. This is another black humor in this land of immigrants, that illegal aliens from across the border can fight for legalizing them; whereas those who came here legally, play by the rules HAVE TO WAIT FOR A DECADE to even get their GC, forget about citizenship. If legal immigrants even open up their mouth, they’ll know what they’ll get and hence no one will dare to speak up.
Moreover, not ALL the legal immigrants suffer this LONG LONG delay. Though I don’t have any statistics at hand to substantiate my claim, after talking to most of my friends, I assume that, maybe around 30-40% of legal immigrants face this ENDLESSWAIT. Most of the guys get their GC in like 4-5 years of time frame, which’s mostly acceptable and hence the voices of those ENDLESSWAITERS will NEVER BE HEARD AT ALL.
2. My priority date is Jan-2001, which’s already passed. But still I’m waiting, waiting and waiting. Attorney of my previous employer kept on saying “you’re this close to getting the card, just hang in there”. I was even wondering if she was meaning it literally when she said “hang” It’s been 2 yrs. since I switched job but still the status remains the same. I sought the help of our Senator’s office to contact Nebraska SC (where my case is pending) and they keep on giving in-consistent replies everytime the Senator’s office contacts them. Here’re the series of responses Senator’s office got :
a. FBI cleared my file in Aug-2007 and handed over to the Nebraska SC and it’s conducting final round of checking before the approval ;
b. A security official has my file, who’ll review the checking done and submit his suggestion ;
c. NSC is conducting ANOTHER round of checking ;
d. My case is one of complicated cases and NSC is seeking advice from their head office in Washington D.C on how to handle cases such as mine.
NO HOPE AT ALL.
3. Not in my case, so I don’t have to worry, thanks to my wife who doesn’t need to depend on me for this.
4. My former employer who filed my case - he was a mom-pop-shop stray-dog, but thinking himself in line with Narayana Murthy, Azim Premji. Ramadorai et all. Though I have a Masters degree and had more than 10 yrs. of experience when I filed my case, he said “company policies” don’t allow to file my case in EB2. “Company Policies”, my foot
5. An L1 holder, who came to the US the VERY FIRST TIME, in L1 got his GC in 3 months; bought a house in the next 3 months, got his wife a job in the next 6 months and SETTLED DOWN. He’s going to be a citizen in the next 5 years, perhaps I’ll be waiting to get my GC even then.
Even a panchayat clerk in my native village can process files much faster than these USCIS folks having a state-of-the-art system and technology.

Muthu’ s horror story saddens and appalls me…it’s also very informative. If I’ve learned anything in this world is that nothing is fair. Chance pays a very important role: from the family and county you are born into, to the time you are forced to put your life on hold for a green card. Nobody really cares about us, so we’ll just have to stick it out, thought…as you well know, it can drive one mad.
I am annoyed most of all by point 2: the immigration process in this country.

I personally don’t feel obliged to “come up” with anything to tell you, techinsurgent. Taking your example, I could ask you to go back from where you originally came from, but I’m not going to do that. As a courtesy for increasing the traffic on this site, I visited yours. You are indeed committed…or you should be.

techinsurgent - I think you’re angry but your anger is misplaced and frankly your question is quite silly. Whether immigration should be allowed or not is not the question here. This country wouldn’t have the green card process or naturalization or even the USCIS if it did not believe in immigration.

Here is my solution - for every H1-B a sum of cash is collected to train Americans - every attempt to be made to train Americans with the money collected and replace the H1-B with an American worker by advertising the H1-B job every year across the US and the American worker who will replace the H1-B will stimulate the economy. All problems solved with no green card process for the H1-B.

Oops. I’ve missed this for a long time.
techinsurgent, whether you like it or not, this country is built by immigrants. This IS the land of immigrants and you can’t do anything about it. So, my point is why not streamline the process instead of complicating it intentionally and marginalizing a section of the legal aliens. When illegals can happily roam around, without paying taxes, and claiming amnesty as if it’s their birth right, why can’t we ? After all, all of us - the legal aliens - stimulate economies in many fronts : real estate - apartments and houses; automobile - cars; entertainment etc. So, don’t act smart dude.

Yeah, we heard this multiple times. If the had been told to your grandfathers or great grandfathers who came here via boats and they had gone back “hooooome”, you wouldn’t be here to post this message.
