What bothers you most?
**** THIS POST WAS CONTRIBUTED BY VANV ****
Hey fellas,
Every time I think of the green card, I experience a wide array of emotions ranging from impassioned to blood boiling, But you have to wonder what bothers you the most…
Is it -
1. Given the plethora of issues in this country competing for attention, this is probably the least likely time that legal immigration will take the spotlight
2. Your priority date is pretty recent and unless there is another July 2007 visa gate, there’s almost no chance of you moving to the 3rd stage with benefits such as EAD, anytime soon
3. The L1, J1 visa holder you know and somehow always bump into reminds you that your spouse stays at home while theirs go to work
4. Your employer simply refuses/ refused to file PERM under EB2 stating the min. job requirements clause (even though you have a masters degree)
5. The J1 visa holders (yeah them again) who file PERM (once they get their H1b) under EB1 get their green cards in 1 year (yes this is true)
6. The “well-wisher” who always told you to stay put in your home country>find a job>settle down>never ever worry abt green card>and if you ever wanted to visit the US, have you BPO employer file an L1/B1 visa for you
There’s more but these few always standout. This isn’t a poll…just my thoughts before I hit the sack. Feel free to add to this list and maybe someday we’ll have a poll (Is the Moderator reading this??)

1. Even if this nation is not having other issues, legal immigrants WILL NEVER EVER get attention. This is another black humor in this land of immigrants, that illegal aliens from across the border can fight for legalizing them; whereas those who came here legally, play by the rules HAVE TO WAIT FOR A DECADE to even get their GC, forget about citizenship. If legal immigrants even open up their mouth, they’ll know what they’ll get and hence no one will dare to speak up.
Moreover, not ALL the legal immigrants suffer this LONG LONG delay. Though I don’t have any statistics at hand to substantiate my claim, after talking to most of my friends, I assume that, maybe around 30-40% of legal immigrants face this ENDLESSWAIT. Most of the guys get their GC in like 4-5 years of time frame, which’s mostly acceptable and hence the voices of those ENDLESSWAITERS will NEVER BE HEARD AT ALL.
2. My priority date is Jan-2001, which’s already passed. But still I’m waiting, waiting and waiting. Attorney of my previous employer kept on saying “you’re this close to getting the card, just hang in there”. I was even wondering if she was meaning it literally when she said “hang” It’s been 2 yrs. since I switched job but still the status remains the same. I sought the help of our Senator’s office to contact Nebraska SC (where my case is pending) and they keep on giving in-consistent replies everytime the Senator’s office contacts them. Here’re the series of responses Senator’s office got :
a. FBI cleared my file in Aug-2007 and handed over to the Nebraska SC and it’s conducting final round of checking before the approval ;
b. A security official has my file, who’ll review the checking done and submit his suggestion ;
c. NSC is conducting ANOTHER round of checking ;
d. My case is one of complicated cases and NSC is seeking advice from their head office in Washington D.C on how to handle cases such as mine.
NO HOPE AT ALL.
3. Not in my case, so I don’t have to worry, thanks to my wife who doesn’t need to depend on me for this.
4. My former employer who filed my case - he was a mom-pop-shop stray-dog, but thinking himself in line with Narayana Murthy, Azim Premji. Ramadorai et all. Though I have a Masters degree and had more than 10 yrs. of experience when I filed my case, he said “company policies” don’t allow to file my case in EB2. “Company Policies”, my foot
5. An L1 holder, who came to the US the VERY FIRST TIME, in L1 got his GC in 3 months; bought a house in the next 3 months, got his wife a job in the next 6 months and SETTLED DOWN. He’s going to be a citizen in the next 5 years, perhaps I’ll be waiting to get my GC even then.
Even a panchayat clerk in my native village can process files much faster than these USCIS folks having a state-of-the-art system and technology.

Muthu: Totally feel your pain…it really makes you wonder about decisions you’ve made in life. Hope things work out for you soon.

Muthu’ s horror story saddens and appalls me…it’s also very informative. If I’ve learned anything in this world is that nothing is fair. Chance pays a very important role: from the family and county you are born into, to the time you are forced to put your life on hold for a green card. Nobody really cares about us, so we’ll just have to stick it out, thought…as you well know, it can drive one mad.
I am annoyed most of all by point 2: the immigration process in this country.
February 20th, 2010 at 12:41 pm
Tell me why should u get a green card ? To make our country great ? Come up with something else.
Why complain …. just pack up and GO hooooome !!
February 20th, 2010 at 9:40 pm
I personally don’t feel obliged to “come up” with anything to tell you, techinsurgent. Taking your example, I could ask you to go back from where you originally came from, but I’m not going to do that. As a courtesy for increasing the traffic on this site, I visited yours. You are indeed committed…or you should be.

techinsurgent - I think you’re angry but your anger is misplaced and frankly your question is quite silly. Whether immigration should be allowed or not is not the question here. This country wouldn’t have the green card process or naturalization or even the USCIS if it did not believe in immigration.

Here is my solution - for every H1-B a sum of cash is collected to train Americans - every attempt to be made to train Americans with the money collected and replace the H1-B with an American worker by advertising the H1-B job every year across the US and the American worker who will replace the H1-B will stimulate the economy. All problems solved with no green card process for the H1-B.

techinsurgent - “for every H1-B a sum of cash is collected to train Americans”
I think there’s already something is place for this. It’s called going to college to get an education.

Oops. I’ve missed this for a long time.
techinsurgent, whether you like it or not, this country is built by immigrants. This IS the land of immigrants and you can’t do anything about it. So, my point is why not streamline the process instead of complicating it intentionally and marginalizing a section of the legal aliens. When illegals can happily roam around, without paying taxes, and claiming amnesty as if it’s their birth right, why can’t we ? After all, all of us - the legal aliens - stimulate economies in many fronts : real estate - apartments and houses; automobile - cars; entertainment etc. So, don’t act smart dude.
“Why complain …. just pack up and GO hooooome !!”
Yeah, we heard this multiple times. If the had been told to your grandfathers or great grandfathers who came here via boats and they had gone back “hooooome”, you wouldn’t be here to post this message.

84% of all current Americans were born here. Doesn’t sound like a land of immigrants to me. Besides, in the past nearly all immigrants were from Europe, not some 3rd world backwater like India. In the past immigrants loved America and wanted to live here. Now they come from all over, hate us, spit on America and just come here to send money home and gain skills. Big difference.
As for stimulating the economy its the American taxpayer that is doing that, not immigrants. If you were all buying houses there wouldn’t have been any housing collapse.
Face it, you think you are entitled to rob America because of some perceived past injustice that evil whitey did to your country and now you are here to settle the score. We know exactly what you are up to.

James - I didn’t write this post to instigate a quarrel. However, your comments warrant some sort of a response. so here goes…
84% of all current Americans were born here - That’s fine. But where did their parents come from - pretty sure not entirely from here.
In the past nearly all immigrants were from Europe, not some 3rd world backwater like India - When immigrants came here from Europe, their countries were in much worse state (war, dictatorship, disease etc) than India is currently.
If you were all buying houses there wouldn’t have been any housing collapse - Would you buy a house if you know your visa is going to expire in 2 years? Nevertheless, a lot of H1Bs have become homeowners in the past few years.
We know exactly what you are up to - Who is we? Are you referring to all Americans? Never assume you are speaking for all of them. People who think like you are a small bunch compared to the sensible folks out there.

James / vanv,
You didn’t quite understand the bottomline of what I said but totally divert the plane of discussion to a different angle which’s totally unwarrented.
I can refute what you said WORD BY WORD. But it’s not my intention. So, let me rest after telling this :
I PITY YOU.
July 30th, 2010 at 12:45 pm
Muthu
No one needs your pity. But after reading your first comment, looks like you need it more than anyone else.
July 30th, 2010 at 8:11 pm
Though it sounded as if I’m seeking sympathy in my original comment, I’m not. In fact I didn’t even bother about my GC as it’s not going to help / harm me anyway.
In fact, to register my comment, I had to gather all my immigration related information, which took almost 4-5 days, b/c I didn’t even care about it.
My comment is about how complicated system has been made and how funny it works. Even my colleague - who is an American by birth - used to make fun of the immigration system so much.
The one who gave his/her feedback to my comment was attempting to hijack the discussion to totally a different angle which requires a separate plane to discuss and debate. Even while drafting my original comment, I had my tongue in cheek, expecting at least one such response and I’m not at all cheated.
My pity was due to the fact that, those who responded me didn’t even understand the tone and tenor of the discussion and attempted to divert it to a different angle.
I take your comment as a passing one.

Umm what part of TEMPOARY don’t you visa holders get? You have all DESTROYED the U.S. Economy with your delusions of being American.
August 6th, 2010 at 8:10 am
OMG … I can’t believe this.
Srini, I would like to request you to introduce comment moderation to reject un-solicited and unwarranted responses that attempt to hijack this threads.
Thanks and regds.

I hate that I studied hard in this country got an electrical engineering degree and now after applying for 300 or so jobs and over 2.5 years, I haven’t even had a decent interview yet. I hate the fact that you slumdogs take all of the american jobs. I hate the fact that you student visas take all of our jobs and stifle our youth. I hate the fact that FOB indians have made studying hard science and engineering in the US a novelty because we can’t find jobs anymore. Our companies and government bend over backwards to accommodate you people more than US citizens. Recently, I was refused admission to a MS in EE, why because east indians from India wanting to study in the US filled up the quota way too quick. So let me get this straight, every single door for has been shut just because I choose to study engineering. I can’t find an entry level job (that’s all I ask for), I can’t go back to school to be retrained. Please don’t get me started.. Please..

What bothers me is how some parents have their babies and younger children on such strict nap schedule and eating times. It’s like when friends or family are over to visit then it’s like ok it’s time now time for the babies or youngster’s nap or he/she needs to eat at this time and the friends or family aren’t hungry yet. You then feel obligated that if their babies or younger kids are eating then you should eat as well.
It really bugs me when new parents don’t like to travel with their newborns or younger children and are always in a rush to just get them home, so they don’t cry as much and so it’s just “comfortable” or more “comfortable”… Or if they do like to travel then it’s constantly like oh we have to be at this place at this specific time so the baby or kid can take his/her nap…
Ugh new parents just deal with your newborns or younger kids and when friends or family are around or going somewhere with friends or family just quit it with the “scheduling” around your children. The “scheduling your newborns or younger kids” is SOOOO unbelievably irritating and makes friends and family uncomfortable and puts that “extra” pressure on your friends and or family because you know that the mother and father want their children at this place at this specific time or be at this specific time for his/her nap or food time.
It’s no wonder friends and family distant themselves for awhile from the new parents because everything revolves around the children and time scheduling. Teach your kids how to nap in the car, how to nap while out and about. That’s another thing that is so irritating to friends and family is when your all out either eating or hanging out somewhere etc etc and the parents again have this schedule and feel as though they have to get their kid home for nap time, food time etc and friends and family just want to hang out but have this pressure from the new parents that they need to “rush” to get the children home etc. Teach the damn kids to sleep while just hanging out, teach the kids that they can’t just go home every single time they are tired, the kids have to learn if they are tired to just sleep where ever they are.
I hate the new parents “time schedules” of newborns or younger children!!

Shut up and go home. You and your ilk are destroying America.
