USCIS Acting Director Jonathan Scharfen

Journal. Read his blog post on USCIS Processing Questions relating to Green Cards, Naturalization cases and I-140 processing.

First, I am glad that the Acting Director is taking the time out to communicate with the immigrant community. It’s a very positive move - creates that much needed transparency and is highly appreciated by the immigrant community, as reflected by the 600+ comments on his blog post. It would be nice if Jonathan responded to some of those in a follow-up post, but regardless, it’s great to know that people now have a direct forum to communicate with the highest authority in the USCIS. I wish all levels, including each service center and department had a blog where they could post the inside happenings and keep their “customers” - us, informally informed.

There are dozens of comments about the I-140 processing delay and the frustration is evident. I recommend more of us to go comment on his blog post to give the USCIS Director a better understanding about the problems that we face as a result of this delay.

The issue about slow I-140 processing and the lack of transparency on the handling of I-140 cases has been brought up several times at the USCIS Ombudsman Teleconferences, specifically on the May 2008 call. To my knowledge, these have not been answered by the USCIS.

The USCIS does not appear to be treating the I-140 delay and the huge backlog of over 700,000 pending green card petitions as a big issue yet at all. The sad thing is that any reform possible by law is unlikely to happen in the next few months since the Congress is at recess for the Elections. In January, the Congress is likely to start discussing the Comprehensive Immigration Reform, which will focus on illegal immigration more than the legal immigration process and again, divert attention away from this problem.

All we can do is keep trying. Responding to the USCIS Director’s blog posts on the Leadership Blog with constructive feedback is one way.
