USCIS and Employers are out of control
i write on behalf of my children who have witnessed the chaos that the sadly broken immigration service call the ‘Green card process’. The stark reality is that there is a continious barrage of hidden traps and pitfalls that hit average families trying to fulfill dreams and careers in this so called free democratic country.
Contrary to popular belief the professional approach many of the elite Employment based applicants adopt, unfortunately is far from matched by USCIS and indeed the legal representation employed by them.
my personal story is of no importance other than it highlights the very worse this system is capable of.
the highlights
1} under H1B visa an employer took advantage by charging me for visa transfer they did not do…. costs $1800………….. i think this is called embezzlement.
2) under “at will contract ” fired for not working on a Sunday cost $21,000 moving etc……………. this is called unfair dismissal
3) under H1B visa not paid the correct overtime payments costs $8400 over 2 years…….. this is called theft
4) under H1B visa salary cut %5 with one weeks notice resign and move costs $17,000…….. this is called deception
5) I-140………… from the above i paid dearly for this document…….. this is called fact
6) i-485 for my family filed costs $3500 the highlight was medical for four $974 for 14 mins with the Doctor ………..this also a kind of theft, deception and fraud?
7) USCIS made a mess of my application and mixed it up with my son took over a year to put right ………..this is plain incompetence
unable to file for EAD extension until-485 sorted out. fired by employer expired EAD costs $12,000 so far……………this is a tragedy
From the above you can see my own story has been an expensive one that has left my family in a disillusioned state that will only end when we leave this place. My wife and sons have become aware that not all things are straight forward and i cannot lie to them saying one day we will be fine here.
Many legal immigrants carry the scars and the wounds lie very close to the surface.

Mark, thanks for sharing your story with us. I feel your pain and will pray that you find the strength to make the right decisions for yourself and your family.
Can you share some additional facts such as your nationality, priority date, dates that you applied for some of documents and your current status. If you don’t feel comfortable sharing that, that’s fine as well. Just that these dates will help us understand the context of your story better.

i really did not intend to go through the whole sorry mess.
To be honest it would hog the forum and i really did not put the story in cronalogical order so please dont try to make sense of it……………no one can.
i intended to highlight some of the bad things that have happened to me during the last 5 years here in the USA.
i am pending renewal of my EAD and maybe i will get my job
back?
i have tried the expedite road on the basis of finacial lose and USCIS errors …………nothing yet i am 5 weeks out of work. and 45 days since i got my receipt for the renewal.
As far as the employer bad behaviour i kissed good bye to trying the courts out. not only can i not afford to take on the corporations in court i really do not want to draw attention to myself when i was techinally out of status due to a transfer of my H1B that never happened.
it is in the passed and we got through it.
i was one who got to file I-485 during July 07 what a mess that was and worst remains so.
please leave my post active and see how may people have had one or more of these things happen.

Mark, I hear a lot of these stories from Indian, Candian, Chinese and Mexican immigrants because the diversity based immigration system means long waits for immigrants from these nationalities. I usually thought that other country immigrants have a relatively easier time. After reading about your case, I feel like I may have been wrong all along. It’s even worse - it’s broken for EVERYONE.

trust me i have found that the employers do not favour anyone in the pursuit of maximium profits and if it means skirting on immigration law then the attitude is.. so be it.
The whole system has been set up to exploit labour and in particular Skilled labour to harness individuals that cannot move on or back. lets be honest who can afford to travel the world with a family looking for work?
i really thought the slave trade had been abolished! this is not true instead of shackles we have economic and bureaucratic handcuffs that tie us to companies and worse we are at the mercy of USCIS and the totally inept system they have invented.
Or is it………..it works for the govenment to keep us in our place a perpetual funding resource. Poetic don’t you think?
Most of us on the skilled employment path have the intelligence and foresight not to do any thing stupid and that is why we are taken advantage of.
simple and without end, the irony is that if the playng field was level all would benefit.

Unfortunately, we are outnumbered by illegal immigrants that do stupid things (jump the wall and get caught) which makes news. And even that problem is not resolved and I don’t see it getting resolved for a long time…it’s difficult to find hope…but yet, that’s all we’ve got. Organizations like IV (Immigration Voice) are doing a good job lobbying but their efforts are not yielding significant results yet. Our only hope is to voice a united opinion through channels such as this site (and hopefully others that are better and bigger).
Indians especially suffer the most. EB3 Cut off date for Indians in the Jan 09 visa bulletin is still July 2001. Yes, more than 7 years of wait after labor is approved. So, total of more than 8 years of wait to get a green card. And we have to work for the same company doing the same thing that entire time, or we lose our status. FREEDOM is what made this country great, and that’s exactly what they are denying us.

Your so right on the illegal point I for one have tried to play this game straight down the line and still got problems.
I feel for the Asian commuinity in general as it is far more likley I will receive my green card sooner because of my European origins… sadly. However the treatment of all resident legal aliens is still a disgrace and despite the best efforts of the organisations dedicated to trying to reform the process we are still swimming against a tide of disapointment.
Never in my life have i felt so unrepresented in a country built on immigration and further to this generally proceeds to pontificate about freedom, justice and fairness.
Dual Standards come to mind.

I too am in the same boat, I have suffered another emotional hit when the March 2009 Bulletin was released. My husband who’s L1B will be expiring next year have decided to leave next year. I have personally been an L1B, H1B and now an L2. I have an approved PERM, I140 but my priority date isn’t current (Jan08), I really don’t for see any changes that will convince us to stay in this country. We will be withdrawing our $$$$ that was saved to buy our home and buy one in Canada instead. I have been with my company for 15 years combined on both sides of the boarder. I will just take my family and my job with me to Canada. Everyone go to Canada, stop wasting your time and life with this broken immigration system!

as a update to my situation i have now returned to work after 3 months waiting and watching the post for my EAD.
my job was kept open more out of fortune than any thing else
i feel for you and your family !
personaly i have lost the passion I had to live in the USA and i am only here to finish my sons education. My wife and i for sure will move on. i simply cannot accept the constant USCIS crap that clouds a very simple process.
the squeeze will come on the legal resident aliens as we are not required during an economic downturn. this is reflected in recent Visa bulletins.
USCIS want it both ways?
i hope thng work out in Canada and sometimes the grass is greener

i was contacted by a recruiter in the USA that opened the old wounds so i decided to complete this story.
i was laid off after 8 months with 2 interim pay cuts for good measure.
finally i gave up.
i am back in the UK.
my Father passed away three months after i got back
I HAD THE BEST THREE MONTHS OF MY LIFE REFLECTING WITH MY DAD …………GUESS WHAT HE DEFENDED THE US SYSTEM! BLESS HIM
never again will i put job,money and travel before my family
