Profile :I have a 3 years Bachelors and 2 years NIIT. 12 Years IT Experience with last 8+ years in US in the same technologies.
Priority Date (2007)
I have EAD/AP and H1b. My questions are :
Can I change from EB3 to EB2.
Does the evaluations done for H1b work for Green cards.
I also thought of getting another 1 year or 2 years PGDCA if that would help but it was mentioned online somewhere that the 5 years experience for EB2 should be after achieving the US bachelors or equivalent.
Non Critical Question : I have EAD/AP and H1b , i need to travel to Hongkong for work, as my H1b visa stamp has expired can i travel on my AP and later on my visit to india sometime this year get my H1b stamped.

Hi,
I am on EB3 category, I-140 approved, awating for I-485 flooding gates to open. What happens if I change my employer now? Can I go over to the new employer, without affecting my I-140. My old employer is willing to continue the GC process for me.
any idea on when the dates would be opened for filing I-485? I have been hearing lot of comments about it this year, starting Jan 2010.

You can always move jobs via H1-B transfer. Your GC petition will remain valid as long as the sponsoring employer does not revoke the I-140.
And then you brought up the million dollar qn, didn’t you?
Except for the powers that be at the DOL noone knows when bulletin dates will move and in which direction.

I’m a H1b visa and got into issue with my old employer who never gave me paystubs or got me a project, so I changed my employer and got a project. Now I’m trying to transfer my paperwork to new company and the old employer is not cooperating what so ever.People gave me option of switching to F1 but even those need paystubs if I plan to do it from being in the country. What are my options at this point please help me. As I’m planning to leave the country as of now and try to re-enter on a f1 visa for the next schooling period. Thanks for your time

I’m a UK citizen with an R1 visa. I’ve been in the US nearly 3 years. I’m currently not ordained but that is a possibility next year. I’m thinking about applying for a Green cards for myself, wife and two children.
Questions:
Is it generally better to apply for a green card now or wait until near the end of the visa in case I’m rejected?
Is it better to get ordained before applying (I heard that non-ordained people are not being accepted at the moment)?
Finally, one child needs their passport renewing. However the passport was issued with the wrong date of birth. The visa has the same wrong date of birth. Should we go ahead and renew the passport with the wrong date, so it matches the visa, or do we need to correct the passport and / or visa to avoid problems applying for green cards?

So I had my consultation with Matthew the other week, i think it went well though Matthew’s area of expertise was more on the business side (I am in the arts), I was till able to get some valuable general info about the green card application process, it will definitely help to have his info and opinions as i go through and try and find a laywer to possibly push forward with the case.

I want to ask something, my mother in law is widow and my husband is her unique son. She is getting older (she is now 79) and with age she has got many problems. She is living at Uruguay with a sister but her son (my husband) wants to take care of her during the next years. She is traveling from Uruguay to Houston and Houston to Uruguay every six months and last time she lost the connections due to bad weather and spent two days at airports.
We have got the green card since 2009 and I understand that we can only ask for her when my husband become US Citizen and he can apply for that during 2014 year. So she has to be traveling during four more years.
I was checking on the USCIS and they say that one person with B-1/2 visa can ask for an extension and they can give up to six months more of stay here in USA. As we want that she comes and stay with us until 2014, my question is could it be possible to justify, by asking extensions for her, that she stay here during that time (30 months minimum)?
I am worry because as I understand, if we keep a person with us that become illegally here we are in the same way becoming illegally and here is my second question, could we loose our green card for keeping here my mother in law and she becomes illegally?

Mayela: I don’t think such a long wait is allowed for B visas normally. You should talk to a good attorney about the possibility of making a special request, I have no idea if such requests are entertained. I know you can get 1 6 month extension but you have to apply for it. But no idea about 30 months. Also remember that even after your husband gets citizenship, your mother-in-law may not get her green card right away, that’s another 12-18 months away.
Girish: If you have a qualifying job offer that demands EB 2, and you can justofy being an “Exceptional professional”, and the job is same or similar (since you are moving on AC21 first), then yes, you can do that, and keep your EB3 prority date., I wrote a post about this recently. USCIS released a memo recently on this topic as well, google it or I’ll post about it..

My question is : I applied H1 in 2008 and it got approved till August 2011. I never got my H1 stamped due to bad economic situation and later got L2 visa stamped on June 2010. Last month I appeared for H1 visa interview and received 221g blue slip and also got Canceled Without Prejudice (CWOP) stamp on existing L2 visa. I have not responded to 221g as we couldn’t get the client letter, Can I get L2 visa re-stamped while H1 is pending under 221g. If
so what are the chances of success for L2. My spouse is in US and have all necessary documents to support my L2 visa.

don’t know if there is much to consult about my case…i just would like to know if there is a way to speed up the processing of my petition..also, i too do not really understand the difference between uscis processing times and the nvc visa bulletin (it is not very specific).
my aplication has been approved by the uscis and is now on hold with the nvc awaiting a visa number…hmmm.
my priority date is september 2006 (uscis nebraska service center pro. date is 2005 / california 2006; nvc cut-off date is 2002)..i just don’t know which one to rely upon.

I am on L1 visa in US and applying for h1. My question is can I travel to India and come back while my H1 is still pending(not approved yet) and return on L1.
Does this in anyway result in cancellation of my H1 or increase the chances.

hi, i have a bachelors in Communication from Canada and am a canadian citizen. Got married, moved to Jersey City, NJ and my husband is on an h1, therefore, i am an h4. I am contemplating starting a childcare business in the Jersey City area as I have prior experience in the field. I am trying to figure out if as an H4, I can do that? If not, can removing myself from the H4, can I start a business as a Canadian? If so, what are the requirements? is there a minimum amount that needs to be invested? Thirdly, if the business is owned by someone else, but I want to work for them (childcare professional), is that a job eligible for H1 and can my employer file for my H1 for me?

If u are going to be a partner in the business with anyone, you CANNOT be working for the business. You cannot be taking a salary. You can only be profit sharing, but you really do have to distance yourself from the business. Like, basically, a silent partner. Watch the business from far and take in the profits. I had asked a similar question from the lawyer and got this answer:)

Thanks for your input. So you are saying, a H1b holder can be sharing profits. This is where I’m confused. How is this different from taking a salary? And if the visa holder can share profit, how does he/she report this income to the IRS.
I’m not expecting an answer right away but just voicing some of the questions on my mind.

My apologies, i thought you were referring to an h4 visa. I am quiet unsure how it works for h1b’s. You are probably better off talking to the lawyer. It may be a little different from h4, but I am pretty sure that as an h1b you can’t start a business either, unless it is considered as part of foreign investment int he country for which the starting amount is 100,000 dollars minimum—

I am on EB2 since Feb 12th 2008 with approved PERM and I-140. I have two Master’s degree from US university and also MBA with BS(Engineering)from India. I am currently in a company where I am poorly treated with same paycheck for 5 years and really disappointed. Though I have 10 years of work experience and techology specialist with good project management, but I am not getting it well positioned.

1. Can I apply to another company and take my priority date to the new company for applying Greencard again? I dont have the copy of I140 or PERM Labor as my company is not sharing me, but i have my receipts alone.

would be interested in a consultation - probably something that can be answered via email and not even need phone time. I am on an H-1B with an approved PERM and my employer is about to file I-140 however my employer is saying that my degree equivalent is only good for EB3 not EB2 filing (but is being very vague about why - “While you do hold the equivalent of a bachelor’s degree, we could not use this for an EB-2 filing.”)
Would love if we could use the time to examine my degree equivalence doc and clarify why it can’t be used (is it worth me fighting, or giving up the dream and taking my family back home - in this economic climate we can’t afford another 5-6 years with only one income)

I have an approved I-140 through EB-1A. The EB-1A was approved in Jan 2011. I applied for I485 along with I-765 (EAD) and I131 (AP) mid-march. I am still waiting for my approval for EAD/AP. I want to clarify a situation.
Right now, i am in H1-B visa status (not stamped). In the next two months i will be moving to a different job. Both the places are non-cap H1Bs. The place where i am moving has suggested H1B visa transfer as there is a remote possibility that I-485 may be denied.
I want to travel to India once my EAD/AP gets approved.
Once i enter through AP/EAD, i would like to initiate the H1B transfer.
1. Is there a possibility that my H1B transfer would be rejected as entering through AP abandons H1B?
The reason for initiating a H1B transfer instead of using an EAD is a remote possibility of I 485 getting denied.
2. In your experience, have you seen EB-1A cases denied under any circumstances?
3. Kindly advise me on this situation. Would you think not traveling to India is the only safe bet?

I’m married to an army man, he is a USC. He will like to petition for my resident visa. I enter the country legally with a visa passport, over stay my visit do to the fact that I was previously petition through my grandfather in 1996 I believe. I also have a 245i. However I worked a few years with false documentation under my name,such as SSN & green card, this worries me. I was advise to be honest when completing my G-325A and that since I’m married to a USC I can be forgiven for using false documentation for employment . I have two children and a husband that I love, they are my all, before I apply I will like to know if I have a chance of receiving a visa. I have everything to loose if I’m force to live the country. my boyfriend was deported 3or 4 years ago for drinking and driving stayed and lived a stable life
in Mexico with me his girlfriend who is u.s citizen in the year of 2008 i came back at 7 months
pregnant and give birth in here in the U.S. our son was born with health issues and needs to be taking medications, blood draws and needs to be seen by doctors in . my boyfriend came back to the U.S in march 2009 illegally to be with here for he’s son who was going go through
surgery. He’s been here living son in ever since and now he father in Mexico is very ill an wants to go see him. Is there way he can get a visa, green card or anything

I know from the bogs that there are other H4 came ahead of me & suffering till they get green card.Appreciating to a fact that H4 permitts to be with husband & make family; I have concerns about it. The H4 life is miserable & due to anger & frustration I’m making my husband’s life the same. He has done master from here but was on low salary last year. Because I couldn’t earn here & share some of his responsibilities, i had to go through an abortion. i couldn’t go back home because there are two of my siblings studying & depending on my parents. I’m willing to take some stand to pass the law for H4 to work for their survival. because sacrification of the happiness does not make the family. It becomes very difficult to run the family on single salary. There should a law permitting for part time job of home-based business. No mind if there is a tax over certain amount made but give someone a right to earn & feed the family with peace of mind…that is what we are only thing asking here….lets united for us…..

I was born in Mexico. I came to the US when I was 5 years old. I’m currently 19 years old. I started kindergarten, then grade school, and I finished high school in 2010. Now I’m going into my 2nd year of college. I don’t have any US documents. I have a Mexican passport, Mexican ID, and an ITIN number. I don’t know why my parents or I didn’t look into fixing our immigration status sooner. I would be glad to send more information via email.

am an American currently living abroad in Morroco since 2005-present. My husband entered the United States in the early/mid 1990’s on a tourist visa. In 2003 my husband voluntary departed from the US and I paid for the plane ticket. It has been 10 years now and I want to file for my husband. Is this possible? To earn a living i began to freelance online as a private placement vendor. I provide confidential prospectuses to corporate environments. I want to file for my husband but owe back taxes (I have filed every year and currently making payment arrangements with IRS pending a reassessment of 2007 taxes). In 2007 my parents and sister came to Morocco to meet my husband and his family. There was a report of investigation done on 06/23/2003 that communicates marriage fraud conspiracy. I did hire a lawyer at the time my husband was detained to pay for a plane ticket to voluntary depart. Which he did and i paid for the plane ticket. I have all the case numbers and paperwork in reference to my husbands case. He did voluntary depart in 2003. My parents and sister are willing to sign “Affividavit Of Support” since i owe back taxes. Will I need the Affividavit Of Support” or Waiver for permission for my husband to reenter US in order to file for my husband?
My reason for living abroad in Morocco is to file for my Moroccan husband to come back to the US, and we did not want to live apart. Although I have lived here for a substantial period of time, it is extremely difficult to maintain a continued financial life in Morocco. In order for my husband and I to be financially successful, we would need to return to the United States. I met my husband in Washington DC (Adams Morgan area lived in same apartment building). When i met him , he was already married to a US citzen. Long story short they went to Immigration interview and lied about living together. INS also detained him for a year and i paid a attorney for him to voluntary to depart. We have since then hired a attorney in DC to divorce from first marriage. I came to Morocco in 2004 and we got married. Ten years have passed is there a solution?
As of August 15, 2011 the USCIS communicated that Americans living abroad can no longer file for alien spouse If there is not a USCIS public office. The closest one to me living in Morocco would be London. Can I fill out all documents and send through mail?

I am currently employed by Company A on an H1 B. I had got a new offer from Company B and had filed for H1 transfer. While waiting for the approval H1 transfer by Company B, I got another better offer from Company C. Now my H1 transfer from Company B is approved. Can I go for Company C and again apply H1 transfer to join Company C and say no to Company B.

Hi my name is Bobbie and I have a friend who is engaged to this meican guy but he is in mexico because he got deported and he has an american wife here in America and him and his wife has not been together for a long time and he has been with my friend for four years they have one child toghter. They are wanting to know would he have to come back here to get his divorce and marry my friend? The lady he is married to now wants a divorce from him but dont want to pay for it. My friend and her boyfriend have been away from each other for almost a year. I am trying to help her because my friend has two kids one is her boyfriend but her oldest only knows her boyfriend as dad and it makes me sad to see my friend and her family split up. Also its not far to the kids to have thier dad in meico when he can be here helping take care of them. He made mistakes to get him deported but when he was here he work very hard to take of my friend and thier kids. So please help me help them. My friend and her guy wan t to get married and do things right.

I have been going around in circles and wish someone could please clarify this one query i have.
I applied for a GC in April 2008 under EB3 and cleared labor and 140 the same year. Since then I have been waiting in the long queue for India. Meanwhile I have been stuck n the same co., at the same job for years. I am currently assistant editor+reporter at a local newspaper in MA and am looking to become editor in the same office. My co. lawyers say it is not possible but they have limited immigration experience and have given me wrong info before. I want to know if I can make the job change without legal repercussions. The salary change is minimal and my job duties change slightly. Currently I mostly report/write and do some editing, layouts, managing interns. In the new job the balance would shift to more of the latter and less of the former. But no drastic change since I have been doing all of this for years anyways.
